Wity Pty Ltd (ACN 624 943 559 / ABN 82 624 943 559), trading as Wity ("we", "us", "our"), respects your right to privacy and is committed to protecting your personal information.

We operate as an Authorised Credit Representative (Credit Representative Number 508333) of our parent company, NF84 Pty Ltd (ACN 30 629 183 633 / Australian Credit Licence Number 531736).

This policy explains how we collect, store, use, and disclose your personal and credit-related information. Our commitment is to abide by the Australian Privacy Principles (APPs) as set out in the Privacy Act 1988 (Cth) (the Act), and the Notifiable Data Breach scheme established under the Act.

This document also serves as our Credit Reporting Policy and includes a statement of 'notifiable matters' as required by law, explaining how we manage your credit-related information.

By providing us with personal information, you consent to our collection, use, and disclosure of that information as described in this policy.

2. What Information We Collect

When we refer to personal information, we mean information or an opinion from which your identity is apparent or can reasonably be ascertained. The information we collect may include:

Identification Information: Your name, residential address, email address, telephone numbers, and date of birth.

Financial & Employment Information: Details of your occupation, employment status, proof of earnings, bank account information, income and expenses, assets and liabilities, and financial commitments.

Credit-Related Information: Information relating to your credit history, such as the amount of borrowings, repayments, defaults, credit capacity, and credit eligibility information provided to us by Credit Reporting Bodies (CRBs). This is explained further in Section 3.

2.1. Sensitive Information

Sensitive information is a specific category of personal information, such as information about your racial or ethnic origin, political opinions, religious beliefs, trade union membership, sexual orientation, criminal record, or health information.

Generally, we will only collect sensitive information (such as health information relevant to a hardship application or insurance policy) if it is reasonably necessary for one of our functions, and only with your express consent.

3. Credit Reporting Policy & Statement of Notifiable Matters

As part of providing you with credit assistance, we must collect and handle your credit-related information. The law requires us to advise you of these 'notifiable matters' regarding how we use this specific information.

We exchange your credit-related information with Credit Reporting Bodies (CRBs). We use this information to confirm your identity, assess your application for finance, and assess your capacity to be a guarantor.

If you fail to meet your payment obligations in relation to consumer credit, or if you commit a serious credit infringement, we may be entitled to disclose this to a CRB. Information disclosed to a CRB may be included in reports provided by the CRB to other credit providers to assist them in assessing your credit worthiness.

Some of that information may reflect adversely on your credit-worthiness and may negatively impact your ability to obtain credit from other lenders.

You have the right to request access to the credit information we hold about you and to request that we correct that information. You may also contact these CRBs directly to request access to, or correction of, the information they hold.

3.2. Your Rights Regarding Credit Information

Pre-Screening Opt-Out: CRBs may use your credit information for "pre-screening" credit offers at the request of other credit providers. You can contact the CRBs listed above at any time to request that they do not use your information for this purpose.

Victims of Fraud: If you believe you have been, or are likely to be, a victim of fraud, you can contact the CRBs to request that they do not use or disclose the information they hold about you. For 21 days after the CRB receives your notification, they must not use or disclose that credit information.

4. How We Collect Your Information

We collect personal information in several ways, including:

Directly from You: When you provide information by phone, in application forms, or by submitting your details through our website and digital platforms.

Call Recording: We may record telephone calls you make to us for purposes such as quality assurance, training, and record-keeping. We will only do this with your consent, which may be obtained verbally at the commencement of the call.

From Third Parties: This includes information from your co-loan applicants or guarantors, your representatives (like your lawyer, accountant, or power of attorney), our referral partners, or financial institutions.

Publicly Available Sources: Such as public registers or social media.

Electronic & Passive Collection: When you use our website, we may collect information about your location (IP address), device, and how you navigate and interact with our web pages (including fields completed in forms). We may also collect information from Facebook or Google if you use those services to log in to our platforms, which helps us provide a more personalized experience.

4.1. Cookies and Digital Tools

We use technology like "cookies" and "web beacons" to analyze how people use our site and improve our service. Cookies are small text files placed on your device; they are not malicious programs.

We may use Google Analytics, including Demographics and Interest Reporting, which categorizes cookie information to help us and third-party service providers deliver more relevant advertising. You can configure your browser to refuse cookies and can opt out of Google Analytics tracking by visiting Google's Ads Settings or using the Google Analytics Opt-Out Browser Add-on.

5. How We Use and Disclose Your Information

We collect, use, and exchange your information so that we can:

Verify your identity;

Assess your financial situation and suitability for a product or service;

Assist you in applying for a loan and manage that application process;

Manage our relationship with you and our business operations;

Conduct research and development to improve our products and services;

Comply with our legal obligations (including under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006) and assist law enforcement agencies; and

Contact you about new products, services, or opportunities available to you (Direct Marketing).

5.1. Disclosure to Third Parties

To deliver our services, we may disclose your personal information to organizations outside of Wity, including:

Our parent company and licensee, NF84 Pty Ltd.

Lenders, financial institutions, or other credit providers to assess your applications.

Your guarantors or proposed guarantors.

Any person who represents you, such as your lawyer, accountant, or finance broker.

Third-party service providers who support our business, such as IT providers, data storage providers, and mailing operations.

Government and regulatory bodies (such as ASIC, AUSTRAC, and the ATO).

Our professional advisers (accountants, auditors, lawyers).

External dispute resolution bodies, such as the Australian Financial Complaints Authority (AFCA).

5.2. Prohibition on the Sale of Your Information

Wity will not sell your personal information to any third party for marketing or any other purpose.

6. Overseas Disclosure of Your Information

The majority of your information is stored on secure servers located within Australia (specifically, the Sydney Region).

However, in the course of our business, we utilize essential third-party service providers and software, such as Google Workspace (which includes Gmail and Google Drive). This means some of your personal information may be disclosed to, processed, or stored by entities located overseas, specifically including the USA.

Furthermore, we store information in cloud and other networked electronic systems. As these storage systems can be accessed from various countries via an internet connection, it is not always practicable to know in which country your information may be held. You should note that while these overseas entities are often subject to confidentiality or privacy obligations, they may not always follow the specific requirements of Australian privacy laws, and in such cases, we may not be responsible for that disclosure.

7. Storage, Security, and Retention of Your Information

We are committed to ensuring the information you provide is secure. We store information in both paper and electronic forms. We take reasonable steps to protect your information from misuse, interference, loss, and unauthorized access, modification, or disclosure.

These steps include:

Confidentiality requirements for all our employees and representatives;

Document storage and data security policies;

Electronic security measures for system access, such as firewalls and data encryption; and

Controlling access to our physical premises.

We have a data breach response plan designed to contain, assess, and respond to suspected data breaches in a timely fashion and to notify you and relevant regulators as required by law.

When we no longer require your information for a lawful purpose, we will take reasonable steps to destroy or de-identify it. However, in some cases (such as helping resolve future disputes or assessing future applications), it may be impossible or impractical to completely remove all traces of your information, in which case it will continue to be protected by the same security safeguards detailed in this policy.

8. Your Rights: Access and Correction

You have the right to request access to the personal information we hold about you. You may also request that we correct any information that you believe is inaccurate, out-of-date, incomplete, irrelevant, or misleading.

To make a request, please contact our Privacy Officer using the details in Section 10.

We will respond to your request within a reasonable period, usually 30 days. We will give you access in the manner you requested if it is reasonable to do so.

We may charge you a fee to cover the administrative cost of providing this access. This fee will not be excessive and will not apply to the lodging of the request itself.

In certain circumstances, we may refuse your request for access (for example, if required by law or if it would prejudice enforcement activities). If we refuse your request, we will provide you with written reasons for the refusal (unless it is unreasonable to do so) and information on how you can complain.

9. Complaints and Dispute Resolution

If you believe we have breached the Australian Privacy Principles or have a complaint about how we have handled your personal information, we want to hear from you. Please contact our Privacy Officer (details in Section 10) and provide us with as much detail as possible so we can investigate your concern.

We will acknowledge your complaint within seven days and aim to resolve it as quickly as possible, providing you with a final decision within 30 days.

9.1. External Dispute Resolution (EDR)

If you are unsatisfied with our final response, you may complain to our external dispute resolution scheme, the Australian Financial Complaints Authority (AFCA). AFCA provides a fair and independent complaint resolution service that is free to consumers.
